Privacy Policy (hereinafter "Privacy Policy") of fashionette GmbH
We take the protection of your personal data very seriously. Therefore, we collect, process and use your data solely in accordance with the German Data Protection Act (BDSG), German Telemedia Act (TMG) and the European Data Protection Directive 95/46/EC of the European Parliament. We would like to inform you about the type, scope and purpose of the collecting, processing and use of your personal data. By giving your consent, you agree to the collection, processing and use to the extent described. You can revoke your consent at any time in the future, for which it is sufficient to send an e-mail to datenschutz@fashionette.de.
1. Information regarding the collection of personal data
Protecting your personal data is very important to us. This privacy policy (together with the Terms and Conditions for our shop) stipulates the foundations for the processing of all personal data that we collect from you or which you provide to us. Personal data include all data that can be personally attributed to you, such as name, address, email address, user behaviour.

If you contact us via email or a contact form, the data you provide (your email address, potentially your name and your phone number) will be saved by us in order to answer your questions. We will delete the data collected in this context as soon as its storage is no longer necessary, or restrict its processing if there are statutory retention obligations.
If we engage commissioned service providers for individual aspects of our services, or would like to use your data for marketing purposes, we will inform you in detail below regarding the operations in question. We will also state the stipulated criteria regarding the duration of storage.
2. Your rights
If your personal data is processed, you are considered a data subject within the meaning of the GDPR. You have the following rights with respect to us as the controller:

3. Collection of personal data when visiting our website
For purely information use of the website, that is, if you do not register or otherwise transfer information to us, we will only collect the personal data that your browser transmits to our server. If you would like to view our website, we will collect the following data, which is necessary for us in order to display our website to you and to guarantee its stability and security (legal basis is Art. 6 (1) Sentence 1 (f) GDPR):

The data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected. When collecting data to make this website available, this is the case when a respective session has ended. The collection of data to make this website available is necessary for the operation of our website. In this regard, therefore, you have no option of objection.
In addition to the abovementioned data, cookies will be stored on your computer when you use our website. Cookies are small text files stored on your hard drive and allocated to the browser you use, allowing the entity that places the cookie (in this case, us) to receive certain information. Cookies cannot run programs or transmit viruses to your computer. They are used to make the internet service more user-friendly and effective as a whole.

5. Objection or withdrawal of consent to the processing of your personal data
- If you have consented to the processing of your data, you may withdraw this consent at any time. This withdrawal will influence the allowability of processing your personal data after you have asserted this right against us.
- If we base the processing of your personal data on our legitimate interests, you can file an objection to this processing. This is the case if processing is no longer required to implement a contract with you, which we will indicate under the following description of each aspect. - We use cookies and other technology to provide you with an optimal and reliable shopping experience, and to continuously improve our service. You can change your cookie settings here at any time.
6. Use of our online shop
- If you would like to place an order in our online shop, in order to conclude the contract it is necessary for you to provide personal information that we require for handling your order. Mandatory information required for handling contracts are marked as such, other information is optional. We will process the data you provide in order to handle your order. To do so, we can transfer your payment details to our principal bank. The legal basis for this is Art. 6 (1) Sentence 1 (b) GDPR.
- You can choose to create a customer account with us, where we will save your information for the next time you shop at fashionette. You may delete the data provided when creating an account at any time. The following information is saved as part of your customer account: Personal information (title, first name, surname, date of birth, email address), address information (delivery and billing address), order and payment information for the last 13 months as well as current order status of your orders.
- If we have received your email address in connection with an order placed by you in the shop, we will use this email address to service emails such as order and shipping confirmations. The data you provide may also be used for direct marketing to inform you about our similar products or services, unless you have objected to this use. We of course clearly and unequivocally inform you that you have such a right of revocation every time you use your email address. Your email address will not be passed on to third parties. At any time you can revoke this consent to the use of your email address for advertising purposes in the future by clicking the >Unsubscribe < at the end of a recommendation message or by sending an email to service@fashionette.de. - Due to the provisions of trade and tax law, we are obligated to save your address, payment and order data for a period of ten years.
- To prevent unauthorised access of your personal data by third parties, particularly financial data, the order process is encrypted using TLS technology.
- Where applicable, to the extent permitted by law and with due regard for your legitimate interests pursuant to Art. 22 (2)(a) GDPR, Art. 6 (1)(a) and Art. 13 GDPR, we will perform an automatic risk assessment and control of the payment methods available to you, as well as a credit check together with our partners if necessary. - When providing your bank account information for payment purposes, we also compare these details with the return debit prevention pool (RPP) of ICD. - We use search technology from Algolia, provided by Algolia SAS, 55 Rue d’Amsterdam, 75008 Paris, France, to show you product lists and enable you to search for products in our online shop. When using the Algolia search function, your IP address and search query will be transferred to a server belonging to Algolia in Europe and stored there. Data is deleted as soon as you close your browser. We have no direct influence on the transfer of this data. The legal basis for the use of Algolia is Art. 6 (1) (f) GDPR. - Our website uses the Google Tag Manager by Google LLC. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”. The company responsible for processing the data and compliance with the applicable data protection regulations is Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). Google Tag Manager is used to manage JavaScript tags and HTML tags, which are used to implement tracking and analysis tools, in particular. Data is processed for the purpose of tailoring our website design to user needs and optimising our website. The Google Tag Manager itself neither stores cookies nor processes personal data. - We utilise Trusted Returns for the efficient handling of returns. Trusted Returns is a service provided by Trusted Returns GmbH, Peter-Joseph-Lenné-Str. 5, 51377 Leverkusen, Germany. An integration of this service on your website will allow you to initiate returns processes directly on their website. To this end, customer data (first name, last name, address, email address), order and shipping data are processed and transmitted to Trusted Returns via the form provided for processing the return in accordance with Art. 6 para. 1 lit. b) GDPR. Based on the entries made and using the software provided by Trusted Returns, we verify your return authorisation. 7. Consent to receiving advertisements: fashionette news, basket reminders and birthday mailings
- When you consent to receiving advertisements, you also subscribe to our newsletter, by means of which we inform you of current offers. In addition to regular newsletters, we will also send you birthday mailings and customer surveys. We will also send you reminders about unordered goods. Information on articles in your shopping cart will be stored and automatically deleted by us in accordance with legal regulations. Our advertisements may be sent by email or by traditional postal mail. Your email address will not be passed on to third parties. The legal basis is Art. 6 (1) Sentence 1 (a) GDPR.
- For subscriptions to our newsletter, we use the so-called double opt-in procedure as well as other forms of consent. - You can withdraw your consent to receiving the newsletter and unsubscribe from the newsletter at any time. You can declare this withdrawal by clicking on the link provided in each newsletter email, or by sending an email to service@fashionette.de.
- Please note that we analyse your user behaviour when mailing the newsletter. Our email communications may contain so-called hyperlinks containing random but unique identification numbers. We (or any external service providers that work for us, such as web analytics service providers) may collect and store these identification numbers when your computer accesses these links to retrieve additional information from our servers. The identification numbers in these links will not be linked to your name, address or other personally identifiable information, unless you have expressly allowed us to send you information specifically tailored to your interests. We use these links and information about your requests to track the use of our emails and website, and to track and measure the success of certain marketing activities. This serves to safeguard our overriding legitimate interests, when duly weighing the interests involved, in approaching our customers with advertising content. 8. Consent to receiving notifications
- If you consent to receiving notifications, we will inform you when items in your basket or wish list get reduced or are available again. We will also notify you when items in your basket or wish list are only available in very low quantities. Information on articles in your shopping cart will be stored and automatically deleted by us in accordance with legal regulations. Your email address will not be passed on to third parties. Furthermore, for analysis of our website by econda (www.econda.de), anonymised data is collected and stored, and user profiles are compiled from this data using pseudonyms. Cookies may be used for this purpose to make recognition of an internet browser possible. Usage profiles will not be linked with personal data about the holder of the pseudonym. IP addresses are made unrecognisable immediately upon entry to prevent any allocation of user profiles to IP addresses.
